一向被視為傳統產業的石化產業,在資訊科技帶動產業生產模式進化後,也逐步朝數位化前進。惟當前石化產業導入人工智慧與大數據尚處初期階段,成果還未顯現,故大體上未對企業效率與市場競爭產生影響。雖然目前國內石化產業投入人工智慧與大數據應用者較少,尚無水平限制競爭疑慮,惟隨著業者對大數據與演算法等數位科技的應用進一步熟稔,未來或可能出現同業間數據交流或建構共同數據集,而有勾結之可能,主管機關仍應加以警戒。石化產業多以中心衛星體系進行供應鏈合作,若石化業中心衛星體系違反垂直限制競爭,仍應適用公平交易法。此外,石化業數位化的資訊服務提供者若掌握關鍵投入要素(如市場資訊),亦須進一步審視有無拒絕交易或差別取價的行為。
The petrochemical industry, which has always been regarded as a traditional industry, has moved towards digitization gradually after the evolution of production models driven by Information and communications technology. However, the application of artificial intelligence and big data in the petrochemical industry is still in the early stages, and the results have not yet cleared, there is no significate impact on firm operation efficiency and market competition. The petrochemical industry currently invests in AI and big data applications is not so much, there is no doubt about anti-competition concern. Once the industry has been familiar with the digital technologies tools, such as use big data and algorithms to exchange data or co-build data set by many petrochemical firms, the possibility of collusion could be happened in the future. It is worth noting by competition authorities. The Central Satellite Factory System was often used by petrochemical industry to improve its capability on supply chain pricing or raising entry barriers and depressing competitors. If the petrochemical industry Central Satellite Factory System has violated the vertical restraints, the competition law should still be applied. In addition, those digital service providers who with essential facility elements (such as essential market information) that help petrochemical industry, it is worth to examine whether there are transactions refusal or pricing differential.
